A divorce lawyer has been appointed to a national advisory group looking into the legal status of prenuptial agreements.
Tony Roe, based in Theale, will be the only solicitor (in private practice), based outside of London to sit on the Law Commission's Advisory Group on Marital Property Agreements.
The Commission is due to publish a consultation paper later this year eventually leading to a report and draft Bill.
Mr Roe, of Tony Roe Solicitors in Brewery Court said, “Marital property agreements, for example prenuptial contracts, (or “pre-nups”), are not currently enforceable in the event of divorce or dissolution of a civil partnership, unlike many other jurisdictions. The court may, however, take them into account when determining what financial orders there should be”.
“This a very exciting time and its consultation paper should get some really interesting responses”.
