
"Do pre-nups safeguard your assets?"

“Can assets be protected by pre-nups?” I found myself speaking on this topic at a recent accountants’ firm event. We still await the judgment of the Supreme Court on the Radmacher v Granatino case, which was heard in March, and only then might we have a clearer answer to this question.
We should have the decision of the historic panel of nine judges later this year. This extended timescale has pushed back the timetable of the Law Commission, which will publish its own consultation on pre-nuptial and post-nuptial agreements only when the Radmacher decision is available.
Meanwhile, the Law Commission is appealing for topics to consider for its next law reform programme. The Law Commission is particularly interested to know what family law, or indeed, other topics, should be examined. Should there be a review on the law of divorce financial provision? Our team has expanded. We have taken on a new solicitor and, also, a new trainee paralegal. A warm welcome to each of them and, I am pleased to say, they appear to be settling in nicely.
Space in the office continues to be an issue, especially as we grow in size. We have investigated the sort of offsite storage systems we had at my old law firm. Solicitors’ offices do seem to generate an awful lot of paperwork, largely due to the paper-hungry court process. However, I was pleased to learn that the Thames Valley courts are now promoting electronic communication via a secure e mail system. Hooray! This will not have a sudden impact, but it is a start.
Meanwhile, the storage company offers a bewildering array of options. We hope to be sending them several lorry loads of boxes imminently.
